Dealing with land? Don’t forget to verify your identity!

If you are dealing with an interest in land, you need to be aware of, and comply with, the new verification of identity rules (VOI Rules).

What do the VOI Rules require?

The VOI Rules require that the identity of a party to a dealing in land must be properly verified, and that adequate proof of such verification is provided to the Registrar of Titles with any document submitted for registration.

If you don’t comply with the VOI Rules, your interest may not be registered on title.

Who does this affect?

The VOI rules affect, amongst other matters, mortgages and conveyancing transactions generally.

If you fall within any of the categories below, you are probably required to comply with the VOI Rules:

  • Purchasers and transferees of an interest in land
  • Vendors and transferors of an interest in land
  • Mortgagees
  • Mortgagors
  • Chargees
  • Chargors
  • Caveators
